Amending MCL 600.2918

Michigan Compiled Law 600.2918 governs tenant remedies and landlord liabilities. UTA is leading the charge to amend this critical statute to close loopholes that leave tenants vulnerable.

The Michigan Eviction Due Process & Notice Act

Purpose: To ensure that no Order of Eviction is issued without proof that the tenant received notice of the Application for Order of Eviction and had an opportunity to exercise rights provided under Michigan law, including the right to seek a stay of execution.

Too many Michigan tenants face eviction without ever receiving proper notice or understanding their legal rights. This Act establishes clear due process requirements that must be met before any eviction order can be granted, protecting tenants from wrongful removal from their homes.

By mandating proof of notice and preserving tenants' opportunity to seek a stay of execution, this legislation ensures fundamental fairness in Michigan's eviction proceedings and prevents the devastating consequences of unlawful evictions.
